Terms and Conditions

 

CHECK IN/CHECK OUT

Check In Time is 4:00 PM: Instructions for obtaining keys and directions to property will be emailed to the guest prior to arrival.  NO EARLY CHECK INS PLEASE.  This is crucial for our maintenance/cleaning schedule to ensure the cabin is properly prepared for your arrival.    

Check out Time is 9:00 AM:  Check-out time is strictly enforced so that Ely Lodging has adequate time to prepare the property for the next guest.  Property and furnishings are expected to be left in the same place and condition as received.  Guests that do not vacate the rental property by 9:00 AM (unless written prior arrangements have been made); a fee equal to the rental rate for one (1) day will be assessed to Guest(s) and charged to credit card on file.

RESERVATION REQUIREMENTS

Deposit: 50% of the cabin rate paid by credit card or personal check is required at the time of reservation.  Upon receipt of reservation deposit, confirmation will be emailed to guest. 

Balance Due: Balance must be received no less than 30 days prior to check-in.  Balance due will automatically be charged to your credit card on file 30 days prior to check-in unless you have made prior arrangements in writing with Ely Lodging.  Upon receipt of balance due, confirmation and directions to the unit will be forwarded to Guest.   

Method of Payment: Visa, MasterCard, Discover, Check, and Money Order Accepted. 

Security Deposit Fees: Refundable Security/Damage deposits will apply.
Damage deposits will be refunded within 14 days after departure in the same manner the deposit was given. Property will be left in the same manner in which is was received. 1. Linens will not need to be washed and beds do not need to be stripped. 2. All dishes will be washed and put away. Dishwashers shall be emptied. 3. All effort and will be made to clean stove, refrigerator and microwave. 4. Furniture, if moved, will be returned to the original position. 5. Dog waste and cigarette butts will be picked up from property. 6. Pets are not allowed on furniture or beds. If hair is found on these items, an extra cleaning fee will apply and will be deducted from the damage deposit. 7. All garbage will be put in the outdoor receptacles with lid. 8. All doors and windows will be locked. 9. The key shall be put back in the lock box. 10. Heat will be turned down to 55 degrees. 11. All watercraft will be tied securely and life preservers placed in a dry area. Once the home is inspected and there is found to be no damage or excess cleaning imposed,your damage deposit will be refunded. By making this reservation, you are agreeing to these terms.

CANCELLATION

All cancellations must be made in writing by mail, email or fax.  Transfers between properties are considered cancellations.  If you do need to cancel your reservation for any reason, please notify us as soon as possible and we will make every effort to re-rent the property.  Guests are strongly encouraged to purchase Travel Insurance to protect your investment. 

Cancellations Made with More than 60 Days Notice: Ely Lodging will retain a $100.00 cancellation fee plus the processing fee and return the remaining deposit to you, OR your deposit, in full, can be transferred to another stay at that property within 12 months. 

Cancellations Made with Less than 60 Days Notice: If the property is re-rented for the same period of time, all monies, less $100 service charge and the processing fee will be returned.  If, after diligent effort, we are unable to re-rent the property, any advance payment will be forfeited.

Refunds:  No refunds will be given for early departures, delayed arrivals, inclement weather, or reducing the number of nights reserved with less than 30 days notice. 

No Show Policy: If Guest(s) do not arrive, all advance payments will be forfeited.

DAMAGES

Security Deposit Fees:  Please see Security deposit paragraph also

Damages: The Guest will at the Guest’s expense and at all times maintain the premises, furnishings and appliances in clean and good condition and will surrender the same upon termination of this Agreement in as good a condition as when received.  Guest will be responsible for any damages or theft. You (your credit card on file and your security deposit) may be charged for such things as but not limited to: damage above normal wear and tear, pet damage, theft, long-distance telephone charges, extra cleaning costs, and, boat and/or motor damage.

GUEST USE AND UNIT CAPACITY

Use - Guest occupancy and use of the premises for recreational purposes must not disturb or offend neighbors.  Quiet time is from 10 pm to 8 am daily.   If a disruptive situation develops, all guests will be asked to leave the premises immediately without refund.  This policy will be enforced without exception. 

Smoking: All of our private homes are smoke-free environments.  Where smoking is allowed outside the residence, all smoking materials, butts and ashes must be picked up and/or disposed of properly.  Failure to do so may result in additional charges to your credit card on file.

Fireworks and Firearms - Fireworks are not permitted at any time.  Firearms may not be discharged in, on, or around the property at any time.  NO EXCEPTIONS.

Unit Capacity - Each unit is designed to accommodate a certain number of guests. Guest may not have an excess number of guests than the maximum occupancy that the unit allows.  Tents, RV’s, and sleeping bags on the floor are not allowed.  The number of guests permitted in the unit should match the number on your confirmation. Please notify us ahead of time if the number of people in your party has changed. Any unregistered Guests over the base rate guest count shall be charged an additional $50.00 fee per night over the standard rate, per person for non-disclosure of the fact.  More than the maximum occupancy of guests at a property is grounds for immediate termination without refund.   

WATERCRAFT 

Boating/Fishing Rules and Regulations - All guests partaking in boating/fishing are responsible to be aware of and abide by the Minnesota Boating and/or Fishing Rules and Regulations.  Minnesota Boating Rules and Regulations and Minnesota Fishing Rules and Regulations booklets can be picked up for free at most gas stations/bait shops in Ely or viewed online at the Minnesota Department of Natural Resources website (www.dnr.state.mn.us).     

CLEANING AND CONDITION OF PROPERTY

Agent(s) will wash linens, dust, vacuum, and sanitize the cabin upon your departure. If additional cleaning is required, appropriate charges will be deducted from your credit card on file.  Guest(s) is responsible for any damage, abuse, excessive cleanup requirements, or loss caused by any member of Guest(s) party to the property or its contents during Guest(s) occupancy.  Inspectors walk through each property after checkout to ensure the property is left in good order.  Agent(s) will make that final determination of the necessity of any charges to Guest(s).

Cleaning:  The following items must be complied with before check out or Guest(s) will encounter additional cleaning charges:

·    Dishes, Pots, Pans, Silverware, and Utensils must be washed; dried and put away (Do Not Leave in Dishwasher) and the stove/oven shall be left in a clean condition.

·    Beds do not need to be made.

·    Refrigerator should be left clean and free of food.

·    All windows and doors must be left closed and locked.

·    Place all trash bags into outdoor garbage cans provided.

·    All litter and cigarette butts must be picked up from the property and placed in the outside garbage cans tied securely in trash bags. 

·    All pet waste must be picked up from the yard and disposed of in trash bags and placed in the outside garbage cans.

·    Property should be left neat and in order (same condition it was when Guest(s) arrived). 

PETS

Pets: Our designated pet friendly cabins are approved for one well behaved dog only for a $125 pet fee.  If you have a cat, other pet, or multiple pets, prior approval is mandatory and we reserve the right to refuse any pets.  If additional well behaved pets are approved, a $125 per pet fee will be added to your reservation.  Where pets are permitted, guests are expected to exercise extra care to maintain the home and property in a clean, undamaged condition.  Any and all pets must be treated for fleas and ticks prior to arrival.  Pets are not allowed on furniture and dogs must be leashed or under voice control when outside.  Pet wastes must be disposed of properly.  Noisy, disruptive or destructive pets are prohibited and will not be allowed to stay.  Any undisclosed pets will result in a $500 penalty charged directly to your credit card on file or forfeiture of your damage deposit, which ever is greater.

SUPPLIES

We Supply: Guests can expect to have a supply of dishwasher soap (where applicable), liquid dish soap, septic safe toilet paper, coffee filters, DISH towels, hot pads, cookware, dishware, silverware, and propane for gas grills (where applicable).   BATH TOWELS ARE NOT PROVIDED

We don’t supply:  Guests should plan to bring their own additional items if they plan to use the following such as all bath towels, personal care items, food, paper towels, laundry detergent (where applicable), charcoal (for properties with a charcoal grill), and firewood.  (PLEASE NOTE:  Some properties supply firewood, but for those that don’t, you will need to purchase firewood in Ely.  Minnesota State Law prohibits the moving or traveling with firewood to help prevent the introduction or spread of damaging forest pests.)  

MAINTENANCE

Maintenance: Agent(s) cannot guarantee against mechanical failure of heating, air conditioning, TVs, Satellite Receivers, VCRs, or other appliances. To report major appliance, plumbing or air conditioning problems, please call Ely Lodging at 888-365-4956.  Agent will make every reasonable effort to arrange for repairs quickly and efficiently or move Guest(s) to a different property if possible. Should a repair person make a call to a unit and find that the equipment is in working order and the problem was due to the Guest(s) oversight or neglect, the charge for service will be the Guest(s) responsibility. No refunds or rent reductions will be made due to failure of appliances or equipment. Authorized employees or repairmen may enter the premises during business hours for purposes connected with repair, care or maintenance of rental unit. We will do our best to have any repairs done quickly; however, NO discounts or refunds will be given for equipment or appliance failure. 

OTHER RULES/CONDITIONS

Keys and Remote Controls: Guest(s) are issued one set of keys at check-in. Upon request, Guest(s) may be issued a second set of keys. As these are privately owned properties, Guest(s) are responsible for lost-keys or remote controls. Guest will be responsible for all costs incurred in re-keying a property due to lost or misplaced keys. In the event that a remote control is lost, misplaced, or not-returned, a charge of $100 will be charged to guest`s credit card.

Lockout Policy: In the event a Guest(s) is locked out of a property, please contact Ely Lodging at 888-365-4956. If an agent is not available, and should a locksmith will be required, the Guest(s) will be responsible for cost of this procedure.

Phone Calls:  Properties that include a land line telephone may be used for free local and emergency calls only.  Guests are responsible for long distance calls and must use credit card, calling card, or collect calls. 

Cellular Service:  Cell phones may or may not work at the property depending on your cellular service provider and the location of the property.  Remember, we are in the remote Northwoods of Minnesota! Rule of thumb:  Verizon is usually the best for cellular service here.

Rates: Rates are posted on each unit’s page individually. Rates are subject to change without notice. 

Personal Property: Guest’s personal property and vehicles are not insured by Ely Lodging.  Ely Lodging is not responsible for any loss or theft either inside or outside the units.

Right of Entry and Inspection:  Ely Lodging will have the rights to enter the premises pursuant to state law (1) In case of emergency, without prior notice and/or (2) To make necessary repairs, alterations, improvements, supply necessary or agreed services, exhibit the premises to prospective or actual purchasers, mortgagees, Guests, workmen, insurance agents, or contractors.

Expedited Eviction: A material breach of this Agreement by Guest(s), which, in the sole determination of the Agent, results in damage to the Premises, personal injury to Guest(s) or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guest(s) tenancy. Violation of any of the rules contained herein will result in IMMEDIATE EVICTION, forfeiture of rent, and charges to your credit card on file for damages if any.     

Guest(s) may be evicted under such procedures if Guest(s):

·    Hold over in possession after Guest(s) tenancy has expired

·    Commit a material breach of any provision of this Agreement that according to its terms would result in the termination of Guest(s) tenancy; 

·    Fail to pay rent as required by this Agreement, or 

·    Have obtained possession of the Premises by fraud or misrepresentation. Any reservation made under false pretenses will result in forfeiture of advance payments and the party will not be permitted to check-in.

Indemnification and Hold Harmless: Guest(s) agree to indemnify and save harmless the Owner and Agent(s) for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use and occupancy of the rental property including but not limited to any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by Guest(s). The terms “Agent(s)” and “Owner” as used in this Agreement shall include their heirs, successors in interest, assigns, employees, agents, and representatives where the context requires or permits. The terms “Guest(s),” “You,” and “Your” as used in this Agreement shall include Guest(s) heirs, successors, assigns, guests, invitees, representatives and other persons on the rental property during Guest(s) occupancy (without regard to whether such persons have authority under this Agreement to be upon the rental property), where the context requires or permits.

Credit Card: Guest(s) will provide credit card number as a guarantee. Guest(s) agrees to pay all rent and/or any outstanding long distance phone charges, accept all terms of the lease agreement and accept all liability for any damage beyond normal wear and tear during the term of the lease with Ely Lodging. If guest(s) fails to do so, they understand that these costs will be charged to the credit card number provided/taken from the security deposit/ or both.  All credit card sales are final!

Taxes: Units are subject to all applicable Minnesota Sales taxes and Lodging taxes, commonly known as the “bed tax”.

Entire Agreement: The parties acknowledge that this Agreement expresses their entire understanding and agreement, and that there have been no warranties, representations, covenants or understandings made by either party to the other except such as are expressly set forth in this Agreement.

Errors and Omissions: We strive that all published information about the rental properties offered by Ely Lodging is as complete and accurate as possible. Our website and print media content is reviewed and updated regularly.  Ely Lodging is not responsible for  inadvertent errors or any unknown changes a unit owner may have recently made to their property.

Compliance with Law: Both parties agree to comply with all applicable federal, state, and local laws and regulations in performing their duties.

Severability: In the event that any provision of this Agreement is found invalid or unenforceable pursuant to judicial decree or decision, the remainder will remain valid and enforceable according to its terms.

Agency Disclosure: Ely Lodging serves as the agent & representative of all owners of vacation properties in its rental program, and is acting at all times, in and for the best interests of the owners 

Notices: All notices, demands or consents required or permitted under this Agreement will be in writing and will be delivered in person or by facsimile, mailed or emailed prior to stay. The service of any notice on one Guest will be deemed a service of all occupants with the premises.
